How Is Assault Defined Under Nebraska Law?

Under Nebraska law, assault encompasses various unlawful actions that intentionally or recklessly cause bodily harm to another person or threaten to do so. Nebraska categorizes these offenses into various degrees based on the severity of the injuries, whether a deadly weapon was used, and who the victim was.

The different types of assault can be based on whether the injuries consisted of any physical impairment, such as a black eye or split lip, or whether the injuries were “serious.” Serious bodily injury causes impairment or loss of a body part or organ for a long time. It can also be a significant risk for death or permanent disfigurement. These serious injuries may be caused by wounds from guns or knives, for example.

Another meaningful aspect of assault is that it is intentional or knowing; as the alleged perpetrator, you knew it would result in injuries. Assault can also be reckless, which means you exhibited a disregard for the safety of others.

Penalties for Assault

The penalties vary depending on the degree of the charge:

  • First-degree (Class II felony): Punishable by one to 50 years in prison.
  • Second-degree (Class IIA felony): Punishable by up to 20 years in prison.
  • Third-degree (Class I misdemeanor): Punishable by up to one year in jail and/or a $1,000 fine.
  • Third-degree (Class IIIA felony for repeat offenders): Punishable by up to three years in prison, 18 months of post-release supervision, and/or a $10,000 fine.

An assault conviction can dramatically alter your future. It can result in a permanent criminal record, making it difficult to find employment, secure housing, or obtain professional licenses.

Additionally, felony convictions can result in the loss of certain civil rights, such as the right to vote or own a firearm. The stigma associated with an assault conviction can also strain personal relationships and damage your reputation within the community.
