Felonies typically result in a year or more of prison time. However, the penalties you will face will depend on the nature of the offense and its circumstances, including whether it involved the use of a deadly weapon and your prior criminal history, if applicable.

Nebraska categorizes felonies in the following categories: 

  • Class I: The most severe criminal charge, punishable by life imprisonment or the death penalty. Class I is further subdivided as follows: 
    • Class IA: First-degree murder is an example that involves the deliberate and intentional killing of another.
    • Class IB: Punishable by 20 years to life imprisonment. An example is DUI manslaughter.
    • Class IC: Punishable by five up to 50 years in prison. An example is armed robbery.
    • Class ID: Punishable by three up to 50 years in prison. An example is burglary involving weapons. 
  • Class II: Prison time ranges from one up to 50 years. An example is the sexual assault of a minor.
  • Class III: No minimum prison time but nine months of post-release supervision if sentenced to prison; the maximum is up to four years with two years of post-release supervision. Examples include reckless vehicular homicide, forgery, and fraud.
    • Class IIIA: no minimum prison time; maximum is up to three years and 18 months of post-release supervision or $10,000 in fines or both. An example is domestic assault with a prior conviction.
  • Class IV: no minimum; maximum prison time is up to two years and 12 months of post-release supervision or $10,000 in fines, or both. An example is possession of a controlled substance with intent to deliver.
